What is Tapmetrik? General description of the service

Tapmetrik is a web analytics and email marketing analytics service that ACC provides to companies that want to apply it to their websites.

In order to provide the service, ACC installs on the client's website code that collects and sends to ACC servers information about the users activity on the website and the actions and events that happen in their email marketing actions.

The customer can access to the reporting center Tapmetrik.com and can analyze the user's browsing data in an aggregated way. In some cases you can view non-aggregated data of a specific user. In addition, the service analyzes and reports the results of its email marketing campaigns, showing in that case the identification of the actions performed by a user associated with the email sent.

Privacy, data collected, how it is obtained and how it is used

General navigation information collection:

In order to provide the analytical service on the customers websites, Tapmetrik collects information that does not personally identify the users who visit the website. This information is what web browsers and servers usually make available, such as the type of browser, the language preference, the reference site and the date and time of each visitor request. Tapmetrik's purpose in collecting non-personal identification information is to better understand how our customers' visitors use their website.

Collection of personally identifiable information:

Tapmetrik can also collect information that can potentially identify people, such as the email to those who have previously accepted the data collection for analytical purposes and improvement of the services provided by our customers. Users IP addresses are not stored. Once the IP address is used to obtain an approximation to the user's location (country, region and city), it is anonymized, avoiding subsequent uses. Nor do you obtain other personal information such as names, surnames or any other form information or similar.

The navigation of a user can be related to your email address, and our customer can use it for analytical purposes (including readings and clicks of emails) or statistical and / or commercial, as long as the end user is subscribed a list distribution and have given permission for such use.

ACC will not make any use of the data collected that is part of the customer account or its users beyond what is necessary to provide and improve the service offered. The data of the customer or of the users of these will not be shared with any third party nor will they be used to send information or for any other purpose.

Access to Google Analytics data:

In addition to the statistics based on the data collection of Tapmetrik seen in the two previous points, Tapmetrik also presents information to the client companies extracted from the Google Analytics accounts to which it gives us access permission.

Tapmetrik uses the Google Analytics reporting APIs to read data about campaigns, attribution, metrics and overall dimensions and present them in a friendly way through graphs and statistics to our customers.

ACC requires its customers to comply with the rules of this service, described in the privacy documentation and terms of use of Google (https://policies.google.com/privacy?hl=es)

ACC does not take any action with the data consulted in the accounts of our clients, neither accumulates nor enriches them with personal information or any other practice that is not allowed.

The relationship and description of the cookies used by Tapmetrik in the websites of our customers are the following, except for an error or involuntary omission or recent update of the service:

General rules of use of the Tapmetrik service

The contracted service must be used exclusively for lawful purposes. It is strictly forbidden to use any of the services contracted for purposes that violate any local, provincial, national or international law or simply affect morality or are offensive to any person or group of people. Any use of the service for illicit purposes will authorize ACC to suspend contracted services without prior notice.

The customer who uses the Tapmetrik service commits to:

  • Maintain the confidentiality of the username and password provided for this and therefore be responsible for the uses made of your account, both by the client and by third parties. In addition, you agree to immediately notify any unauthorized use of your accounts.
  • Meet the current regulations regarding the laws of protection of personal data. It should reflect in the privacy policy of the website where the Tapmetrik service is provided the existence of such service and that data of the user's navigation and in some cases some personal identification data, such as the user's email, will be collected.
  • Do not transfer information to ACC through the Tapmetrik service that can identify a person, with the exception of email when the user has given his permission explicitly. The customer commits not to collect the email from users who have not given their express consent.

In addition, the customer commits to use the Tapmetrik service in a diligent, correct and lawful manner and, in particular, commits to abstain from:

  • Delete, evade or manipulate the copyright, trademarks and other data identifying the rights of ACC, incorporated into the contents and/or products marketed from our website.
  • Use the contents and, in particular, ACC information obtained through our Web Site to send advertising, communications for the purpose of direct sales or with any other kind of commercial purpose, unsolicited messages addressed to a plurality of people.
  • Reproduce or copy, distribute, allow public access through any form of public communication, transform or modify the contents, unless you have the authorization of the owner of the corresponding rights or it is legally permitted.
  • In general, use the service for purposes or effects contrary to the law, morals and generally accepted good customs or public order.

The Tapmetrik service can not be used in websites that are dedicated to:

  • Disclose or transmit illegal, abusive, defamatory, racist, offensive, or any other type of objectionable information, either through photographs, texts, advertising banners or links to external pages.
  • Publish, transmit, reproduce, distribute or exploit any information or software that contains viruses or any other harmful component or material that is not original (pirated) or that may infringe intellectual property rights.
  • Publish sites that aim to illegally obtain access codes to email accounts or bank accounts or provide material or resources about hacking, cracking, or any other information that may be considered inappropriate.
  • Publish, transmit, reproduce, distribute or exploit material that contains child pornography or any related marketing.

Intellectual property

All content available on the Website, including, but not limited to, text, graphics, logos, icons, images, audio clips, data and software compilations and their collection (Intellectual Property Content), is owned by ACC, and It is protected by intellectual property laws. ACC declares that the industrial property rights (Trademarks, Trade Names, etc.) that appear on this Web Site are its property, being duly protected by the existing Regulations on Industrial Property.

Limitation of liability

ACC declines any responsibility derived from a use not authorized by these general conditions.

The customer shall be liable for damages of any nature that ACC may suffer as a result of the breach of any of the obligations to which it is subjected by virtue of these General Conditions or the Law in relation to the Use of the Website.

Duration and modification

The information that appears on this Website is current as of the date of its last update. ACC reserves the right to update, modify or delete the information on this Website.

ACC reserves the right to make, at any time, as many changes and modifications as it deems appropriate, being able to use this power at any time and without prior notice, regarding the availability of its products, services and campaigns.

ACC reserves the right to unilaterally modify these General Conditions, its privacy policy and any other information. The entry into force of the modifications of the General Conditions will occur from the moment of its publication on this Website.

Applicable law and jurisdiction

The present conditions will be governed by Spanish legislation, which will be applicable in what is not provided in these conditions in terms of interpretation, validity and execution. ACC and the user submit, at their discretion, for the resolution of conflicts and renouncing any other jurisdiction, to the courts and tribunals of Donostia/San Sebastián.

Language

ACC may translate these general conditions, our privacy policy, or any other operational standard, policy or procedure that may be published on the site. The Spanish version will prevail in case of conflict.
